EVAC Accused Of Negligence, Lawsuit Ends With $10 Million Verdict | Daytona Beach Medical Malpractice Attorney

A DeLand jury has agreed upon a $10 million verdict in a medical negligence case.  In 2003, Margarita Stivers Chess was transported by ambulance from Bert Fish Medical Center in New Smyrna to Central Florida Regional Hospital.  During the ride, Chess gave birth to Addison Chess two months premature.  As a result of this early delivery, Addison suffers from brain damage and blindness.  The mother had already started contractions when she was picked up by EVAC.  The jury found that EVAC was negligent in transporting her at that time.  The medical centers and doctors involved settled the case for $1.4 million.  EVAC, which went to trial, is responsible for the other $8.6 million.
